General Terms and Conditions

Upresent provides the delivery presentations and images of gifts purchased from our affiliate and partner retail sites. We have no involvement in, nor can we take any responsibility for the actual physical delivery of a gift purchased from a retailer using our Online Delivery service. It is the responsibility of the gift purchaser (Sender) to determine what manner of physical delivery is chosen during the purchasing process at the retail site (ground, overnight, etc.).

If any indication of when the Online Delivery recipient should expect the gift is wanted, the Sender must add this to the Online Delivery message. Any change in shipping availability or backorder notification is sent to the gift purchaser only by our retailer affiliates. Each retailer has their own standard procedures and policies regarding these issues. As a courtesy, the Sender may want to e-mail the recipient of any change in the expected delivery or any product change in the event of any change in the gift being sent so the recipient will not be confused by a change from what they were shown in the Online Presentation.

Upresent makes all efforts to assure that we partner and offer our Online Delivery capabilities to retailers who are reliable regarding delivery and stocking merchandise offered for sale. Even the best retailers do occassionally run out of stock on an item, or a delivery company like UPS, the Postal Service or FedEx may lose a package. Upresent only represents that the Online Delivery will be made as scheduled, letting the Recipient know that the Sender did remember them, buy a gift and arrange an Online Delivery Presentation. We have no control over or ability to influence the actual physical gift delivery.

Upresent has selected reliable sources to ensure that we are always available and always able to make the online delivery presentations selected. However, we cannot take any responsibility for a technical difficulties or failures from our vendors or internally that may inadvertently result in a delivery being lost, not being made or being delayed.

Registration Information

When you register as a member of Upresent, you may choose whether to receive email messages from us in the future. The types of messages we send include, expanded presentation notices and updates regarding our site's services.

When you send one of our online delivery presentations, the information you provide is used to personalize your experience with the recipient's name and with your message, and to deliver an email notification to the recipient. We treat our online deliveries and the content you create as private correspondence between sender and recipient and will not disclose the contents of any presentation. However, if you provide a false email address or attempt to pose as someone else when sending a delivery, your Upresent membership is subject to cancellation, and information about you -- including your computer's IP address may be disclosed as part of an investigation into your actions.

Other Contests and Promotions

Upresent may sponsor contests or promotions or allow other companies to sponsor contests or promotions on our site. In order to enter a contest or promotion, you may be asked to provide personal identifying information, and by doing so you agree that such information may be disclosed to the contest's sponsor, whose identity will be clearly indicated on the entry form. We treat the information provided for our Wishes the same as that of our member registrations. Other companies who sponsor or co-sponsor our wishes may have their own policies and information you submit will be subject to those policies as well. Although Upresent encourages third parties to adhere to appropriate privacy standards, we are not responsible for the actions or policies of third parties.

Age Policies

We do not solicit information from children and request that users of our service not be under the age of 13. Upresentawish WISHES or sweepstakes drawings are limited to senders and recipients over the age of 18. Any person identifying themselves as a minor will not be allowed to register at Upresent.com or if we receive written notice that a person is under 13 years old, we will close that members account.

Sponsors and Business Partners

Our affiliate retail partners also may offer you the opportunity to sign up for their services or information, such as newsletters or promotions. In these instances, Upresent is not responsible for personal information provided to these sponsors or how it is to be used.
